Months after a lawsuit filed by a university student against Hainan Airlines for departing 10 minutes earlier than scheduled in April, the high-profile case has seen new developments.
起訴海航的大學生小胡在社交媒體發文稱,經過多輪協商,海南航空方面表示將在今年7月30日前修改規則。目前,他因出行計劃被打亂而產生的住宿費也已經收到。
The 19-year-old student, surnamed Hu, posted on social media recently that after multiple negotiations, Hainan Airlines has agreed to amend its internal policies by July 30 and he has also received compensation for the accommodation expenses incurred due to the disruption of his travel plans.
據中國新聞周刊此前報道,19歲大學生小胡原計劃于4月3日早上7點40分從深圳飛往呼和浩特。起飛前數日,他接到海南航空通知,航班將提前十分鐘起飛。

這個變化打亂了小胡搭首班地鐵前往機場的計劃,他提出免費退改簽機票,之后又提出由航司承擔打車前往機場或提前住在機場附近的費用,均被海南航空拒絕。
The dispute dates back to early April when Hu had planned to fly from Shenzhen to Hohhot at 7:40 am on April 3. However, days before departure, the airline notified him that the flight would take off 10 minutes earlier than originally scheduled.
This change disrupted Hu's plan to take the first subway to the airport. He initially requested a free ticket refund or rebooking, and later asked the airline to cover the cost of a taxi ride or an overnight stay near the airport, but all these requests were rejected.
小胡表示,從出發地到深圳寶安機場有30公里,打車至少需要百元。而且在他看來,早晨乘坐地鐵前往機場,是變數最小的交通方式。而航班提前10分鐘起飛,意味著停止值機和登機的時間也會提前,自己乘坐地鐵前往機場的計劃,變得極不保險。
最終為了確保趕上航班,他提前一晚住在了機場附近的賓館。

小胡稱,自己于3月27日向深圳市寶安區人民法院遞交訴狀,要求海南航空賠償住宿費,承擔訴訟費,更重要的是確認海航的格式條款無效。4月13日,中國民用航空局消費者事務中心出具了調解意見書,海南航空拒絕就他的訴求進行調解。

海南航空認為,航班時刻僅供參考,不構成航司與旅客合同的組成部分;且根據該航司最新一版運輸總條件相關條款,提前10分鐘屬于正常航班,只有提前超過15分鐘,才可以為乘客進行免費退改簽。
The carrier argued that flight times are for reference only and do not constitute part of the contract between the airline and passengers. According to their latest transportation terms, a 10-minute advance is considered normal, and only departures more than 15 minutes earlier qualify for free rebooking or refunds.
小胡則認為,根據交通運輸部公布的《公共航空運輸旅客服務管理規定》,由于承運人原因導致旅客非自愿變更,應免費退改。同時,其購票所使用的權益卡購買時間也早于新版條件生效時間,不該受新規限制。
Hu contested this position, citing the Provisions on the Management of Public Air Transport Services for Passengers issued by the Ministry of Transport, which stipulates that passengers are entitled to free rebooking and refunds when involuntary schedule changes are caused by the carrier.
He also noted that the travel benefits card he used to purchase the ticket was bought before the updated terms took effect, and thus the new rules should not apply to his booking.

據小胡自述,5月22日,海南航空表示愿意承擔住宿費,但是否修改運輸總條件依然需要討論,當時他本人并未同意收取該費用。5月30日,海南航空承諾將在7月30日前修改運輸總條件,小胡在咨詢法院工作人員后收下了103.84元的住宿費用,并承諾將在海航修改運輸總條件,雙方無異議后,再簽署調解書。
According to Hu, on May 22, Hainan Airlines offered to cover the accommodation fee but said that revisions to the terms were still under discussion — Hu declined the payment at that time.
On May 30, the airline contacted Hu again and committed to revising the rule by July 30. After consulting with court staff, Hu accepted the 103.84 yuan compensation and stated that a mediation agreement would be signed once the updated rules were finalized and both sides had no objections.
